Quick answer: An NC DVPO renewal motion must be filed by the aggrieved party before the current order expires. Under G.S. 50B-3(b), a court may renew for good cause for up to two years, including an already-renewed order. A new act of domestic violence after the existing order was entered is not required by that provision.
How long can the original order and renewal last?
Under G.S. 50B-3, an original protective order has a fixed term no longer than one year. A renewal may last up to two years. Read the actual expiration date; the maximum permitted term is not the duration of every order.
The statute generally makes orders expire at 11:59 p.m. on the indicated date unless the order states otherwise. Calendar the filing deadline early enough to address paperwork and service questions rather than waiting until the final day.
What does good cause require?
The court must decide whether good cause supports renewal. The statute says a new act after entry is not required, so the inquiry should not be reduced to whether someone violated the order during its term.
Present specific facts relevant to the request and any response. Prior orders, compliance history, communications, and ongoing circumstances may need legal review. Neither renewal nor denial should be promised merely because the parties have had no recent contact.
What if the renewal hearing is after expiration?
The statute allows a temporary renewal on the plaintiff’s ex parte application in that situation. Its duration is limited to the earlier of the renewal hearing or 30 days after the current expiration date, absent the express written consent described in the statute.
Filing a motion should not be treated as proof that a temporary extension was entered. Obtain the signed order and confirm service and the hearing date. The request, the court’s decision, and the final renewal hearing are separate steps.
Does renewal extend temporary child custody?
The statute does not permit renewal of the temporary custody award beyond the maximum one-year period through this process. A renewed DVPO and continuing child-custody authority must therefore be analyzed separately.
If custody terms are nearing expiration, obtain advice on the appropriate Chapter 50 proceeding and how existing orders interact. Do not assume the entire custody arrangement continues just because other protective provisions are renewed.
What should both sides track?
Keep the original order, every renewal or modification, filing receipts, service information, and hearing notices. Use the newest signed order to identify current restrictions.
A defendant responding to renewal should not contact the protected person to seek withdrawal if contact is prohibited. A plaintiff seeking renewal should use the court process rather than rely on informal assurances that an order will remain active.
Frequently asked questions
Must there be a new assault for renewal?
The statute does not require a new act after entry. Good cause must still be shown.
Can an order be renewed more than once?
The statute permits renewal of an order that has previously been renewed, subject to the required motion and good cause.
Does a pending renewal motion automatically prove protection continues?
No. Confirm the existing term and whether the court entered any temporary renewal.
