Going to court in Union County

Union County is one of only a handful of North Carolina counties with a DWI treatment court, and it also has a veterans treatment court. For someone facing a repeat DWI, the treatment court can mean intensive supervision and treatment instead of the usual path. It is demanding and not right for everyone, which is why it should be weighed early with a lawyer who knows the requirements.

Union County’s magistrate’s office is located at the county jail on Presson Road in Monroe. That is where release conditions are set after most arrests and where bond is usually addressed. If a family member was just arrested, the most useful things to have when you call us are their full name, date of birth, and the charge listed on the arrest paperwork.

What happens after an arrest in Union County

  1. Magistrate on Presson Road. After an arrest by Monroe Police, a town department, the Union County Sheriff, or the Highway Patrol, the magistrate at the jail sets release conditions.
  2. First appearance at the Judicial Center. District Court calendars for misdemeanors, DWI, and felony first appearances are held at 400 North Main Street.
  3. Negotiation with District 30. We test the evidence and negotiate with the District 30 prosecutors in the same building.
  4. Trial, treatment court, or resolution. Depending on the case, the path may be a District Court trial, an appeal to Superior Court, a negotiated resolution, or, for eligible repeat DWI cases, treatment court.

If you or a family member was just arrested, call (704) 842-3411 now. Have the person’s full name, date of birth, and the charge from the paperwork ready.

Yes. The North Carolina Judicial Branch lists Union County among the few counties with a DWI treatment court. It serves high-risk, high-need people with repeat DWI charges, using close supervision and treatment. Union County also has a veterans treatment court. Eligibility is screened, so ask your lawyer early whether either option fits.

The Union County magistrate’s office is located at the Union County Jail, 3344 Presson Road in Monroe. After most arrests, the magistrate sets conditions of release there, such as a written promise, an unsecured bond, or a secured bond. A lawyer may be able to ask a judge to modify conditions later.

Most do not. Many misdemeanors are resolved through dismissal, deferral, or negotiated pleas with District 30 prosecutors. If your case is tried, a District Court judge decides it without a jury. If you are convicted there, you have the right to appeal to Superior Court for a new trial before a jury.
